Implementation of an adapted criminal hearing for suspects with a mild intellectual disability: an analysis based on the ECHR framework


In 2019, the Public Prosecution Service (OM) initiated a pilot programme with the objective of adapting criminal hearings for suspects with mild intellectual disabilities (MIDs) to ensure fair trials and mitigate the risk of adverse outcomes. It is of significant importance to safeguard the effective participation rights of the vulnerable suspects in order to comply with the ECHR. This study concludes that the implementation of these practices on a national scale would enhance access to justice and improve the fairness of trials for suspects with MIDs.
